What do you need help with?

Your info is only used to answer your request. Never sold.

Roofing, metal roofing and metal building work performed by Jose's Construction, a licensed Oklahoma roofing contractor (license #80002601). ECS Enterprises Inc. handles your estimate and project coordination.

The short version

Oklahoma law (59 O.S. § 1151.30) says a roofing contractor may not advertise or promise to pay, directly or indirectly, all or part of your insurance deductible, or offer to compensate you for providing any service, as an inducement to sell roofing work paid from an insurance claim.

What the law covers

  • Residential and commercial roofing contractors.
  • Repair or improvement work paid by the homeowner from property or casualty insurance proceeds.
  • Advertising or promising to pay all or part of the deductible, directly or indirectly.
  • Offering to compensate the insured for providing any service, as an inducement to the sale.

What roofers must do

Every roofing contractor must give written notice of this rule with its initial estimate. The adjuster or insurer must also include the notice in its initial estimate on the claim.

If a roofer breaks the rule

The insurer is not obligated to consider that roofer's estimate. Any person can file a verified written complaint with the registrar, who forwards it to the Oklahoma Insurance Department and the Office of the Attorney General, and refers it to the district attorney.

How we handle it

We never offer to pay or waive a deductible, and every written estimate includes this notice. Roofing work is performed by Jose's Construction, a licensed Oklahoma roofing contractor (license #80002601). Your insurance company decides coverage; we document what we find with dated photos and a written scope.

Questions

Frequently asked questions

Can a roofer pay or waive my insurance deductible in Oklahoma?

No. Under 59 O.S. § 1151.30, a residential or commercial roofing contractor working on a job paid from property or casualty insurance proceeds may not advertise or promise to pay any part of your deductible, directly or indirectly, as an inducement.

Can a roofer offer me money or a credit for a yard sign or for letting them use photos?

The same section bars a roofer from offering to compensate an insured for providing any service as an inducement to the sale. We do not make those offers.

What happens if a roofer breaks this rule?

The statute says the insurer is not obligated to consider that roofer's estimate. Anyone can file a verified written complaint with the registrar, which is forwarded to the Oklahoma Insurance Department and the Attorney General.

Will I get this notice in writing?

Yes. The law requires every roofing contractor to give written notice of this rule with the initial estimate, and the adjuster or insurer must include it in their initial estimate too. Our written estimates include it.

Do I still pay my deductible if my claim is approved?

Your deductible is set by your policy, and your insurance company decides what a claim covers. Ask your agent or insurer about your own deductible.

Is this legal advice?

No. This page summarizes the statute in plain language. Read the full text at the link on this page, and talk to your insurer or an attorney about your situation.
